7. User-Submitted Recipes & Content

By submitting any content (recipes, images, text, or other materials) to Crisp Munch, you represent and warrant that:

  • The content is your own original work or you have all necessary rights and permissions to share it;
  • The content does not infringe upon any intellectual property, privacy, or other rights of any third party;
  • You grant Crisp Munch a perpetual, irrevocable, worldwide, royalty-free, sublicensable, transferable license to use, reproduce, modify, adapt, publish, translate, display, distribute, and create derivative works from your submitted content in any media;
  • Submitted content is subject to review and may be edited, rejected, or removed at our sole discretion without notice or explanation;
  • You will not submit content that is harmful, dangerous, misleading, defamatory, obscene, offensive, illegal, or violates any applicable laws or regulations;
  • Crisp Munch assumes no liability for user-submitted content, including but not limited to the accuracy, safety, or legality of submitted recipes.

8. Recipe Submissions & Publishing Fees

Recipe submissions are currently free. Crisp Munch is in its early growth phase, and we are accepting community submissions at no cost while we build the collection. By submitting a recipe, you acknowledge and agree that:

  • All submissions are subject to review and may be approved, edited, or rejected at our sole discretion without notice or explanation;
  • Submission does not guarantee publication, featuring, or any specific placement on the Website;
  • Any social media URL you provide with your submission may be displayed publicly alongside your recipe to credit you as the contributor;
  • We reserve the right to introduce a non-refundable publishing fee in the future. If a fee applies at the time of submission, it will be clearly disclosed before payment, and all such payments will be final and non-refundable;
  • When fees apply, payment processing is handled entirely by third-party providers (such as Paddle, acting as Merchant of Record), and Crisp Munch is not responsible for any payment processing errors, disputes, or security issues.

9. Author Profiles

When a recipe or blog post you submit is approved, Crisp Munch automatically generates a public Author Profile page associated with the name and email address you provided. By submitting content, you agree that:

  • Your display name, profile photo (if uploaded), short bio, favorite cuisine, location, years of experience, social link, published recipes, published blog posts, and any reader ratings or reviews of you as an author may be displayed publicly on your Author Profile;
  • Your email address is kept private and is used solely to verify ownership when you request to edit your profile, upload or change a photo, or update bio fields;
  • Edits to your profile require email-based verification — clicking the secure link we send confirms ownership of the author identity. You are responsible for keeping access to that email account secure;
  • Author Profiles are tied to email identity, not display name. Two contributors who share the same name will have separate profiles;
  • Profile photos, bios, and other profile content must be your own and must not violate any third-party rights, contain misleading information, or include offensive material. We may reject, edit, or remove any profile content at our sole discretion;
  • Reader ratings and reviews of authors reflect the opinions of individual users and not those of Crisp Munch. We are not liable for opinions, statements, or claims made in author ratings or reviews.

10. Blog Post Submissions

Crisp Munch accepts community-submitted blog posts in addition to recipes. By submitting a blog post, you agree that:

  • All blog post submissions require email-based verification before entering our review queue;
  • Submissions are subject to manual review and may be approved, edited, or rejected at our sole discretion without notice or explanation;
  • All representations, warranties, and license grants set out in Section 7 (User-Submitted Recipes & Content) apply equally to blog post content, including text, images, and any embedded media;
  • You will not submit blog posts that contain spam, misleading health or medical claims, hate speech, defamation, plagiarism, undisclosed paid promotion, or any unlawful content;
  • Once approved, your blog post title, body, cover image, author name, and any social link you provide may be displayed publicly and indexed by search engines.

11. Indemnification

You agree to fully indemnify, defend, and hold harmless Crisp Munch and the Released Parties from and against any and all claims, demands, actions, damages, losses, liabilities, judgments, settlements, costs, and expenses (including but not limited to reasonable attorneys' fees and court costs) arising from or related to:

  • Your use of or access to the Website;
  • Your violation of these Terms;
  • Your violation of any applicable law, regulation, or third-party right;
  • Any content you submit, post, or transmit through the Website;
  • Any claim that your content caused damage to a third party;
  • Any food preparation, cooking, or consumption activities based on information from the Website.

This indemnification obligation shall survive the termination of these Terms and your use of the Website.

12. Limitation of Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRISP MUNCH'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THE WEBSITE OR THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE ACTUALLY PAID TO CRISP MUNCH IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

13. Third-Party Links & Services

The Website may contain links to third-party websites, services, and content. We have no control over, and assume no responsibility for, the content, privacy policies, practices, availability, or accuracy of any third-party sites or services. All intellectual property rights in the Website, including but not limited to copyrights, trademarks, trade names, logos, designs, and proprietary information, are owned by or licensed to Crisp Munch. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to indemnification, limitation of liability, disclaimers, and intellectual property provisions.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Crisp Munch regarding the use of the Website and supersede all prior agreements, understandings, and communications, whether written or oral.

The failure of Crisp Munch to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by Crisp Munch to be effective.

Crisp Munch reserves the right to modify, amend, or replace these Terms at any time at our sole discretion without prior notice. Changes become effective immediately upon posting. Your continued use of the Website following any modifications constitutes your binding acceptance of the revised Terms. We recommend reviewing these Terms periodically.

20. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be resolved exclusively in the state or federal courts located in Delaware. You consent to the personal jurisdiction of such courts and waive any objection to venue.

21. Force Majeure

Crisp Munch shall not be liable for any failure to perform its obligations where such failure results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, government actions, power failures, internet disruptions, or pandemics.
